Worker’s Compensation

HMO in Montclair, California

The employer makes the initial selection of physicians in the state of California. However, after a period of time as stated by the state law, the employee is free to choose his or her own physician, unless the employer or the employer’s insurer has established a “medical provider network.”

An employee, who has notified his or her employer in writing prior to an injury that they have a primary physician and whose providers offer a non-occupational health care coverage, has the right to be treated his or her personal physician after a job-related injury. The right to be treated by one’s primary physician at the outset of an injury also applies if the employer was unable to post a notice of workers’ compensation rights as required. Should an employer or insurer establish a medical provider network, then under most conditions, the employer controls the initial selection of the physician and all care must be provided within the network for the period of the claim.
